Negligence
A trip case is where you fall over a defect or an obstacle
in any public place. Often in the street or in any building
or area to which the public have access.
Remember there is always a good possibility for a claim
if there is a defect, obstacle or dangerous situation
and those responsible cannot avoid liability by saying
it was your fault (for any reason).
THEY ARE AUTOMATICALLY NEGLIGENT!
FOR EXAMPLE: Even if you were on someone elses land
and suffered an injury you WILL have a claim.
Remember- All shops and similar public places have strict
duties to inspect maintain and keep their premises safe.
Many accidents are caused by the negligence or carelessness of others.
----------
Road Accidents
Road accidents can happen at any time.
Sometimes the blame can be placed on
badly maintained road surfaces
or even faulty road-signs and signals. Or just someone elses bad driving!
What to do!
Following the accident.
Stop !
You must stop if you are involved in a
road accident and any other person, dog,
horse, sheep, cattle, pig not in your vehicle
has been hurt or any other vehicle or roadside
property apart from your own has been damaged.
You do not have to stop if you run over a cat!
After the accident you will be disorientated to
some degree and may need your energy to cope with
pain and discomfort as well as damage to your property so
STAY CALM.
Despite the shock and distress you feel,
stay calm and do not admit liability.
TAKE DOWN DETAILS OF THE ACCIDENT
You will need to note as many details about
the accident, how it happened, where it happened,
who may have seen it, as possibleit will help when
you make your claim.
Give your name and address or the vehicle
owners name and address (if different) and
the vehicles registration number to the
police and to anyone who has reasonable
grounds to require them.
PASSENGERS AND CHILDREN ALWAYS HAVE CLAIMS.
IT DOESN'T MATTER IF THERE WERE NO WITNESSES
OR THE POLICE WEREN'T INVOLVED.
Get the drivers name and address and their insurance company.
If you are injured go to hospital or the doctor
as soon after the accident as possible.
----------
Accidents at Work and Industrial Injury
This is any injury or accident where your employers or
a fellow employee have been careless or negligent.
Often employers try and shift responsibility onto you,
this is not the case:
THE LAW IS STRICT.
They will be liable for your injury and are by Law insured.
Employers usually do not tell you this!
The injury could be one accident such as a fall or on a machine
or it could develop over a period of time. The most common kind
are lifting/ back injuries where you may nor realise until later
that you have suffered injury.
WHATEVER THE CIRCUMSTANCES YOU MUST REPORT
THE ACCIDENT AND SEEK MEDICAL ADVICE.
Q: What kind of jobs do people do who make industrial injury claims?
A: Any kind of work environment can lead to an accident at work or an injury sustained through common work practices.
Stress can also be the cause of a compensation claim!
Accident book and any treatment sought immediately should be noted
----------
Medical Negligence
Its not about ambulance chasing its about exercising your rights,
when something has gone wrong with treatment and where the
explanation may not be satisfactory.
Sometimes it is obvious:
a failed operation, wrong condition treated or diagnosed.
Sometimes it is less obvious:
Remember- You are not an expert and experts do not find
it easy to tell you that something went wrong.
A delayed or incorrect diagnosis and poor treatment are the
most common types of medical claims.
You must not be frightened or put off- you must ask questions
and get answers.
Injuries may not be noticable until later
We are experts - we can advise.
Important:
Doctors, hospitals and nurses are always insured.
Almost all cases settle successfully.
Approximately 3/4 of all people who could- do not claim
because they worry about costs and taking advice.
Most of these people have justified claims but are too
scared to enquire.
Don't lose out- make sure you exercise your right to at least ask an expert.
It costs nothing!
